Source: The Seattle TimesSept.迷你倉最平 19--A King County judge has fined the University of Washington more than $720,000 for withholding 12,000 pages of public records from a professor who believed she was wrongfully denied tenure at the Tacoma branch campus.After the professor lost a discrimination case in federal court, records turned up that might have helped her press a case that she was discriminated against because she is French, according to the Sept. 11 ruling by King County Superior Court Judge Monica Benton.Among the documents were some that "contained derogatory references about her French national origin," according to a summary of the case posted by the plaintiff's attorney, Jack Sheridan, on his firm's website.UW officials said they disagree with the findings, as well as the method by which the penalty was calculated, and would likely appeal the decision.The professor, Isabelle Bichindaritz, worked at the UW-Tacoma's Institute of Technology from 2002 to 2010 and applied for tenure three times in the computer-science department, in which all tenured faculty were male, according to her attorney.Sheridan could not be reached for comment.Bichindaritz was denied promotion and tenure in 2009, and believed she had been discriminated against because of her gender and national origin, Sheridan wrote.In 2009, she requested from the UW a complete copy of her personnel file to press a discrimination case in federal district court.According to the ruling, the university knew Bichindaritz had filed an Equal Employment Opportunity Commission complaint, and later a federal lawsuit. PAUL, Minn. -- As a new item in the men's college hockey display case, the Big Ten Conference has done some eye-catching things thus far.No gasps of genius or beauty mind you; just a nice collection of pieces that reflect a higher level of competence and earnestness than we're used to seeing from some of the more established operations.One example is being offered here today. The Big Ten has brought its six coaches, select players and top administrators to the Xcel Energy Center for a preseason media gathering.It's hardly a new concept for the Big Ten -- the league has long done it for football, men's and women's basketball -- but it's a novel approach for many of the long-timers who follow college hockey.There's nothing like putting faces to names -- making meaningful contact with coaches and key decision-makers in the league -- especially when the alternative has long been a torturous 90-minute teleconference where the commissioner, of all people, routinely chimed in with questions of the coaches while a handful of participants winced.The inaugural Big Ten media gathering is being staged in St. Paul because of its vibrant hockey heritage and because the well-appointed 'X' will be the site of the inaugural league playoff tournament in March. All six schools -- Michigan, Michigan State, Minnesota, Ohio State, Penn State and the University of Wisconsin -- will play in the single-elimination event with a berth in the NCAA tournament going to the victor.The media day model is so inviting that the newly formed National Collegiate Hockey Conference -- which counts Minnesota-Duluth and St. Cloud State among its eight members -- is staging the same thing today in downtown Minneapolis.The Big Ten gathering comes the same week that the league rolled out the bulk of 文件倉ts Big Ten Network schedule. If there's one item in the display case that grabs your attention, it's all the projected TV exposure. By the time the full lineup for 2013-14 is complete, it's expected that more than half of all Big Ten games will be televised nationally.That prime-time ratio overwhelms the rest of college hockey -- 53 schools of varying budgets and profiles scattered over five other leagues -- and feeds into the fear that the well-heeled Big Ten will drive smaller programs out of business.That paranoia has raged ever since a billionaire, Terry Pegula, gave Penn State more than $100 million to fund men's and women's hockey programs and an arena on campus three years ago. That gave the Big Ten the six members it needed to sanction the sport and led to massive realignment, which will be unveiled when the season begins next month.What critics fail to appreciate is that, because of the Big Ten, college hockey now has a more formidable identity.Issues and inequities that have plagued the sport -- whether with the NCAA or the NHL -- have largely gone unresolved over the years. Why? Because college hockey's fragmented, overmatched leadership resembled a bunch of squeaky voices in the back of the room.That won't be the case with the Big Ten. Its booming baritone tends to be heard loud and clear on matters of athletic administration, governance and protocol. Its methods of persuasion, while arrogant to some, tend to get results.In short, the Big Ten gives college hockey a presence it's never had before. That shouldn't be feared. Gay marriages are blossoming everywhere, as social barriers come crashing down almost at once, but not in conservative Hong Kong, where pressure is building against the prejudice toward same-sex couples.迷你倉Ming Yeung reports.Jacky never recovered from the heartbreak of separating from the one he loved, and who for ten years was his soul mate. He wanted to stay — even until his last breath — but the love between Jacky and another man did not survive, even after three years of being legally married, when his partner’s parents in Canada refused to accept the bond.The investment banker, now in his mid-40s, remembers the look of cold loathing in the eyes of his partner’s father. It made him feel like some unsavory character, even a criminal.The two young men had met at a social gathering and soon fell in love. Jacky’s partner was a high school teacher from a family he described as “exceptionally traditional”. “He was the eldest son of a family of intellectuals, and expected to produce offspring to carry on the family name,” Jacky said softly.“When we became stable, he talked to his parents about our relationship. His father went ballistic, and said (to Jacky’s partner), ‘If you want to be with him, I will renounce you.’ The words made the school teacher feel as if he’d had his heart torn out,” Jacky recalled. “But he decided to leave the family and be with me.”The bittersweet love was hijacked by Fate, when they were given the shocking diagnosis that his partner had cancer of the kidney. The illness had entered its final stage and Jacky’s partner was given but six months to live.Jacky remembers the day the teacher called his father to say goodbye before entering hospital and with tears in his eyes, to plead with his father to accept Jacky. But the old man was unmoved, and declared he would never accept Jacky as his “son-in-law”.While his partner lay unconscious, near death, Jacky was ordered to leave the ward. He never saw his partner again, nor was he invited to the funeral.“I feel like I owe him lots. I didn’t fulfill my vow to be with him until he died…” Jacky paused, searching for the right words to express his feelings. “I keep asking myself this question all these years and still haven’t figured out an answer, ‘What did I do wrong?’”Same-sex marriage is not permitted in Hong Kong. It is not recognized, even in cases like that of Jacky and his partner with the couple legally married elsewhere. Same-sex partners can’t be considered in public housing applications, tax allowances for spouses, health-care insurance, applications for entry by family members for family reunions or the disposal of estates.The once reticent gay community, however, has stepped out from the shadows in recent years and become more militant-spurred, to some extent by high-profile coming-out-of-the-closet announcements by leading pop singers and a newly elected lawmaker.Peter and Vicky never may fulfill their dream that one day they may marry and start a family. They are star-crossed lovers who, like Romeo and Juliet, or “the Butterfly Lovers,” are separated by society and its conventions. Both are Hong Kong citizens denied the right to marry each other because they are lesbians.They have been together since 1990, back in the days when even the word homosexual was seldom spoken in polite company. Their relationships with their respective families took on a kind of “don’t ask, don’t tell” armistice, with both families “sort of accepting” their “daughters-in-law”.“Marriage is fine but for people like us, I never thought it was necessary,” Peter told China Daily. Lately, however, Peter started to feel differently and began considering tying the knot with her longtime girlfriend. “It is a commitment to her. We’re just asking for the rights enjoyed by heterosexuals for so long. What’s wrong with that?” asked Leung, who used to have a partner from the US. When the relationship became stable, the couple began to consider entering a new stage and starting a family. Neither Hong Kong nor his partner’s hometown allowed gay marriage. Feelings cooled, and as the two saw no future together, they parted.LGBT advocates rallyBig Love Alliance, a non-profit organization, was co-founded early this year by Legislative Councilors Cyd Ho Sau-lan and Raymond Chan Chi-chuen, artists Anthony Wong Yiu-ming and Denise Ho Wan-sze, socialite celebrity Gigi Chao, and some others who advocate equal rights for the LGBT (lesbian, gay, bisexual, and transgender) community.Apart from not being entitled to the same rights in law as a married couple, Leung said, gay couples are not even entitled to next of kin rights when their partners are ill in hospital, nor are they permitted to claim the remains when their partners die.Last November, a motion proposed by Cyd Ho, calling for public consultation on legislation to protect the rights of sexual minorities, was voted down by the Legislative Council. ”當前發達國家經濟面臨的種種問題,儲存倉其實都可從資本主義的信息論中找到答案。靠政府擔保而勉強維持經營,實已有違資本主義原則。政府擔保由於將因有誤而受質疑的先決條件排除在外,只會摧毀知識和財富。除非容許創業有誤導致失敗或企業破產,否則就無法創造新知識和財富。“本欄今期的推介文章為吾友吉爾德(George Gilder)近期一篇力作,這位多產作家是「科技創新天」觀念(technological utopianism)的忠實信徒,文中指稱環球經濟發展至今「已不再純屬一種誘人以利的系統」,而演變成為「一種資訊導向的系統」;對經濟定義作出如此嶄新的演繹,無疑令人耳目一新。所謂「資訊」,歸根究柢,重點應在於為既有系統注入新意。至於經濟層面,關鍵繫於發明創造與創業精神。吸收新資訊之後,就可將之化為知識。基於這個理念,吉爾德認為,構成財富的真正元素已非金錢或物質,而是一點一滴累積而成的知識。事實擺在眼前,除非環球經濟得以大事變革,一新面貌,否則制度內空談革新之聲雖然不絕於耳,只會徒然分散注意力,妨礙知識傳播,而財富分配民主化之舉,就會以失敗告終。不過,正如吉爾德在下文中所言: 「資本主義經濟體系的轉化,自能與人類心智的發展並駕齊驅。」由此觀之,筆者深慶經濟發展前景仍大有轉機。下文中選段,亦有助於讀者了解為何現有貨幣制度如此漏洞百出。事實上,各國央行所以力有不逮,皆因除了掌管貨幣政策的正業以外,解決就業問題的重責竟也落在其身。由於板斧有限,央行在解困過程中與市場溝通往往辭不達意,其想法亦一直未能衝破舊樊籬,吉爾德等前�作家在著作中宣揚的嶄新思想範式,自然不在各央行行長的考慮之列。一旦明白到固有制度如何不足,投資者對未來經濟發展自然漸有眉目,在今後異常波動的市況中,應能較好掌握如何調整投資組合。以下文章作者為美國著名作家兼George Gilder Fund Management主席吉爾德。為何許多美國人看來相信這一套:即使全靠負債與加稅才能支撐政府開支,依然有望藉以帶動經濟增長、創造財富?為何仍有不少美國人相信聯儲局人為壓抑下的低利率,竟會有助於刺激商業和投資活動?我相信,箇中原因實植根於經濟學界將知識與力量混為一談的成見。不少經濟學家認為,經濟增長的動力源於行使力量,而行使力量的象徵,在於創造金錢,以及政府所作開支及種種擔保。透過運用「經濟機器槓桿」(levers of theeconomic machine),集於政府的力量足以擴大需求,同時誘導企業投資以及消費者花錢。其中的過程即被視為有助於產生需求,從而帶動經濟增長。經濟更替契機以上經濟模式的元素,在種種新式機械和新能源相繼問世的年代,正是經濟學「創世記」的組成部分。顯而易見,最早期出現的經濟模型就正好以當時蒸汽機驅動工業革命的力量為基礎。不過,近數十年來,我在探究科技投資的過程中,卻發現重點每每在於有關信息論研究中的重重知識網絡,而非力量的來源。單就理論層面而言,信息論只涉及與各種網絡以及電腦相關的科學;至於背後的其他層面,則足以改變社會上對財富本質根深柢固的種種概念,從而顯示真正的財富,其實並非金錢或權力或需求,而是知識的累積。信息論的誕生,始自1930 年美國奧地利裔數學家哥德爾(Kurt Godel)發表的論文,其中闡述「哥德爾不完全性定理」(Godel's Incompleteness Theorems),指出一切邏輯體系,包括數學在內,都具備先天不完全性的本質,其所憑依據為根本無法證明的種種公理(axioms)。如此劃時代的重大發現,卻礙於用以印證的數學方程式異常繁複,而往往未能解說清楚。不過,美國匈牙利裔數學家諾伊曼(JohnVon Neumann)就率先認定哥德爾所印證的上述定理徹底推翻宇宙以及經濟自成體系的概念;哥德爾本人亦應心中有數, 「自行創造」(autonomous creation) 的概念,其實亦隱含於其研究的驗證之中。哥德爾定理亦間接成為「圖靈機」(Turing machine)的理論依據。「圖靈機」由英國數學、邏輯兼密碼學家圖林(Alan Turing)所發明;此一抽象邏輯自動機,更成為日後一切電腦科學的基礎。圖靈證明但凡電腦系統,都不可能具備完全性及一貫性,他的結論是一切邏輯體系先天具備「神諭」(oracular)性質。電腦根本無法像阿當史密斯式的「碩大機器」或牛頓式「世界體系」一般,而只能倚賴電腦程式員或所謂「神使」(oracle)一類人物,因而永難超越其創造者的局限。正如圖靈在其著作中指出,他本人無法規限「神使」的行為,只能說「先知並非機器」而已。電腦的神使就是電腦程式員;經濟的神使就是企業家。1948 年,任職貝爾實驗室及麻省理工學院(MIT)的天縱奇才工程師香農(Claude Shannon),將哥德爾及圖靈的重大發現,化為一套用以衡量信道(communicationschannels)容量的技術概念,以供負載信息之用。香農的研究結論是一切信息基本上均具「不確定性」,因為若非如此,各類通信之中就無法包含新信息。因此,牛頓式世界體系或史密斯式偉大機器之類有序而意料之內的機制,根本並不包含亦不會產生任何新信息。我研究科技發展已長達數十年,終於發現如何破解經濟思想當前飽受困擾的種種迷思。資本主義經濟其實主要是一種信息體系,而非機械式的誘因體系。財富則無非是知識的累積。「不確定性」的現象,也可視為自由程度和創意準則的一種尺度,以發信者的選擇自由,亦即香農信息論中所謂的「信息內容」(entropy)為衡量標準。可能發出的信息愈多,則接收一方面對已發信息的不確定性就愈高,因而收到信息時,所取得的信息也就較實際信息內容為多。在今年6 月出版的拙作《知識與力量》(Knowledge and Power)中,我將信息論總結為人類通信,或信息創造作為信道傳輸,不論信道為一條電纜抑或傳遍全球的網絡,在雜信下所產生的成果以其「新聞性」或「不確定性」衡量,基於此而界定為「信息內容」,隨之轉化為知識。由於有關通信或創造有可能是商業計劃或實驗,信息論為經濟學提供的理論基礎,在於企業(產生知識及財富)的不確定性,而非以均衡狀態和秩序為依據。因此,但凡信息論所涉及的過程均必然具實驗性質,而所有結果均可因有誤而被推翻。但凡進行創業實驗的企業,均須容許屢敗屢迷你倉的空間,否則就難以產生知識,因而無法創造財富。財富的實質價值,不在可供貪財之輩或政府據為己有的物質資本,而在只能在自由土壤開花結果的學習過程及知識創建。信息經濟特點畢竟早於石器時代,人類就已具備所有與今人大同小異的物資及物欲。古今財富的差異,並非自利意識的無限膨脹,而是好學不倦的進程,期間任由企業家甘冒失敗之險,亦要屢敗屢戰的種種實驗。信息論以至有關電訊及互聯網的理論,均極具啟發意義,令我邁上發掘新經濟學之途,從而將企業家及發明家的創舉,由備受冷落的邊緣地帶納入經濟體系的中心位置。由此可見,知識不但是一項財富之源,更是財富的本質所在。至於以信息為本的嶄新經濟學有何真知灼見,則可歸納為下列12 大要點:1)經濟基本上並非一個誘因體系,而是一個信息體系。2)信息處於秩序或均衡狀態的對立面;資本主義經濟體系並非均衡體系,而是動態環境,以便企業家開展實驗,從而產生實用而可因有誤而作廢的知識。3)物理學有所謂物質守恆定律。只有知識才可經積累而成。所有經濟財富及進展,均建基於知識的擴充。4)知識具離心力,並藉此分布於人腦之中。經濟發展倚靠資本的類似擴散力量,從而抗衡政府的向心力。5)創意乃新知識的來源,往往在令人意想不到的情況下出現;否則社會主義就會大行道。經濟學家盲從物理學的決定論(determinism),因而誤將不確定性排斥在外。6)通信系統中信道與內容之間的互相干擾稱為雜信。雜信有礙於識別信道中的信號,因而有損信息傳輸及知識增長。7)不論是電磁波譜,抑或有憲法可依的房地產業權及任何法規,傳輸高信息(不確定性高的)內容必須倚靠低信息(不確定性近乎零的)內容傳輸媒介。8)別具創意的創業之舉,須以低信息內容的媒介為資金來源。在幣值不穩而政府斂財的波動市況中,經濟難免因前景暗淡,而但求交易頻仍甚或不惜大舉套戥,以致金融投機活動過度活躍。9)華爾街從來冀望市況波動,而交易頻仍,更指望政府在大跌市中收拾殘局。一般投資者與科網界則但求幣值平穩,而所獲利潤受到法律保障,從而為投資作出長遠部署。10)GDP 增長若主要以事後按成本計價的政府開支為基礎,而罔顧消費者�眼未來的明智決定,則無論增長如何可觀,亦只是虛有其表。無論以負債或加稅手段支撐,作為「刺激」經濟措施的政府開支,必然以政府自甘放棄知識力量為代價,因而消滅信息,同時拖慢經濟增長。11) 一如熱力學(thermodynamics)的平均溫度,實質利率代表整體經濟的平均預期回報。一如信息論的信息內容,企業盈虧代表不確定或意料之外的結果。人為操控的利率,只會混淆源於實質創業機會的任何信號,因而把整體經濟導向無意識交易及套戥活動之途。12)知識既是一切創業之舉的目標,也是財富之源;其價值超乎追求任何追求知識的動機。知識之本與知以致用的力量密不可分,強行切斷兩者關係,只會導致經濟失效。當前發達國家經濟面臨的種種問題,其實都可從資本主義的信息論中找到答案。靠政府擔保而勉強維持經營,實已有違資本主義原則。政府擔保由於將因有誤而受質疑的先決條件排除在外,只會摧毀知識和財富。除非容許創業有誤導致失敗或企業破產,否則就無法創造新知識和財富。觀乎高盛及房利美等大企業全靠政府大力資助及擔保才能存活的現象,目前的所謂經濟復蘇,不過是掩人耳目的假象而已。信息造就文明知識經濟本質樂觀;正如已故名記者兼政治經濟學家萬尼斯基(Jude Wanniski)在其著作中指出: 「經濟增長不在平民百姓口袋�有多少錢,只在其腦袋中有多少創意。」美國政府開支在二戰結束之後的兩年驟減61%;智利國營企業在上世紀70 年代由500 家減為不足25 家;以色列及紐西蘭經濟在80 年代一夜之間全面私有化;東歐及中國在90 年代亦陸續實施經濟私有化;瑞典及加拿大近年亦有效法�象。由此可見,經濟環境確可於一夜之間徹底改變,權力隨之重新分配,而出乎意料的個人創意力量亦會隨之釋放。二戰後德日兩個戰敗國經濟迅速復蘇,更是財富等於知識的有力明證。當年兩國不但陷入物資嚴重匱乏的困境,廠房及生產設備又已在戰火中幾乎悉數摧毀。近數十年來的經驗足以證明,單靠外國經濟援助,只能暫借財經及政治力量,若缺乏創業家的知識和創意,實不足以創造財富。信息論是復興一切藝術及科學的根基,其中包括物理學、生物學,以至數學及哲學。經濟環境得以改弦更張, 基於信息實乃無序(disorder) 而非有序(order)的識見。宇宙亦非不斷消磨人類自覺獨特的意識與自由意志的碩大機器,而是建基於造物者形象的創意空間。不確定性信息同一道理,資本主義亦非處於均衡狀態的體系,而是啟動顛覆和發明的機器。一切經濟增長及人類文明,均源於創意的不確定性,以及憲法秩序領域中知識增長。美國阿根廷裔大數學家兼算法信息論(algorithmic informationtheory) 始祖蔡滕(GregoryChaitin),解釋其理論時指出,要在任何社會、經濟或生物科學領域捕捉不確定性信息,須靠從電腦世界引入的嶄新創意數學才能成事。信息論的信息內容是衡量不確定性、無序、隨機性、雜信、失衡,以及複雜性的指標,也是量度選擇自由的準則;其經濟成果在於創意和利潤;站在其對立面的,則包括可預測性、秩序、低複雜性、決定論、均衡狀態,以及暴政。可預測性和秩序均非自發性質,亦不可任由隱形之手處置;須靠低信息(不確定性近乎零的)內容媒介負載高信息(飽含不確定性的)內容信息。在資本主義制度下,可預測媒介包括法治、治安、財產權的保障、規則的可靠性及規限性、賬目的透明度、貨幣的穩定性、家庭生活的紀律及前景,以及與政府可見職能相稱的稅收水平。凡此種種,均為負載人類從不確定性財富及文明進展所得一切收穫的低信息內容媒介。作者為著名投資分析專家,其前沿思考(Thoughts
