NetLink-OpenNet deal: IDA to consult public
M1 is first off the mark to deride NetLink's proposed OpenNet acquisition[SINGAPORE] The Infocomm Development Authority of Singapore (IDA) is considering whether NetLink Trust's proposed acquisition of OpenNet would substantially lessen market competition or harm public interest.迷你倉To this end, it launched a public consultation on the matter yesterday and will seek inputs from the public and industry players during the next three weeks.But, already, the proposed deal has drawn fire, with an early salvo coming from telco M1, which said the deal favours rival telco SingTel and would stand in the way of the development of a "competitive and vibrant broadband market".Singapore's other telco, StarHub, said it was studying the issue and would soon give its feedback on how it believes the deal will affect the industry.These reactions follow the news last Thursday that NetLink Trust had entered into an agreement with OpenNet's four shareholders - SingTel, SP Telecommunications, Singapore Press Holdings and Canada's Axia NetMedia - to buy their respective stakes for a total sum of $126 million.OpenNet is the consortium behind Singapore's ultra-fast fibre broadband network, while NetLink Trust owns and maintains the manholes and ducts through which broadband cables pass in order to reach buildings and homes.Yap Chee Keong, the chairman of CityNet, NetLink Trust's trustee-manager, said the proposed transaction will "drive greater efficiencies" in the provisioning of services" by creating a single entity that owns and manages the Next Generation Nationwide Broadband Network (NGNBN), as well as the ducts, manholes and central offices.Since being revealed, however, the proposal has come under scrutiny because SingTel is the sole owner of NetLink Trust's units.If it goes through, SingTel would be the only company able to provide services across the entire spectrum quickly and extensively - from building the fibre, owning the channels through which the cables will pass and rolling connectivity out to buildings and homes.The proposal is still subject to the IDA's regulatory approval, since the proposed change in ownership raises concerns that the consolidated entity could substantially reduce competition in the telecommunications market and stymie the continuation of an open-access environment here.However, while SingTel has a 100 per cent economic interest in NetLink Trust, the telco is unable to influence its major operational or management新蒲崗迷你倉decisions, and has no effective control over the trust; it is why it meets IDA's "no effective control" requirement.The majority of CityNet's board is independent.To enhance the actual and perceived independence of the new consolidated entity, SingTel has proposed to cease its role as the key subcontractor for the installation and maintenance of the fibre network within 12 months of the completion of the deal. This would offer other approved facilities-based operators such as StarHub and M1 an opening to step in to provide their services as well.But M1, expressing disquiet yesterday, said through its spokesman: "The Government's intent for the NGNBN is to bring about a competitive and vibrant broadband market via an alternate ubiquitous network that can effectively compete with the only ubiquitous legacy network in Singapore."The proposed consolidation will result in SingTel having 100 per cent indirect ownership of OpenNet, which negates what the Government set out to do and further entrenches SingTel's incumbent position."In a reference to SingTel's proposal to divest its unitholdings in NetLink Trust to under 25 per cent by April 22, 2018, M1 noted that this was an extension from the original 2014 time-frame given."Clearly, there are concerns whether NGNBN's key role and strategic objectives can be achieved," M1 said.It added that the proposal "fails to address the underlying issues impacting customers that have persisted even after three years of OpenNet's operations"; the competitive benefits - in terms of how the transaction will improve the operational efficiency or lower costs for consumers - are "also not apparent".StarHub's chief marketing officer, Jeannie Ong, said: "We are particularly interested in how this transaction could improve OpenNet's poor performance on service provisioning record for non-residential customers."Industry watchers BT spoke to believe IDA's decision will largely be shaped by the feedback provided by other service providers in the NGNBN landscape.Bryan Tan, an intellectual property lawyer and partner in Pinsent Masons, said: "I think the telcos will play a pivotal role with the submissions they make, because they're the ones with direct knowledge on issues of pricing, issues of access, issues of how smooth the current or proposed processes are."IDA's decision - on whether to reject, allow or approve the proposal with imposed conditions - is likely to be published before the end of the year.mini storage

Woman Asks to Take Back Plea in Feces-, Drug-Filled House Case
Source: The Times-News, Twin Falls, IdahoAug.self storage 28--TWIN FALLS -- A woman who was scheduled to be sentenced on a drug charge Monday has asked to take back her guilty plea.Tina Deane, 49, was initially charged with possession of methamphetamine, possession of drug paraphernalia and injury to a child.Police said Deane allowed her 10-year-old son to live in a home filled with drugs, drug paraphernalia and animal feces.At Monday's hearing in Twin Falls County court, Deane's attorney, Ron Bird, said Deane intended to ask to take back her guilty plea and have a trial, partly because she was worried about her eligibility for Social Security disability insurance."I would like to take back my plea because one -- I'm not guilty," Deane said. "I will lose my son and I will lose my SSI."Without insurance, Deane said, she wouldn't be able to pay for her medications and her health would quickly deteriorate, she said.In June, prosecutors dropped the misdemeanor paraphernalia charge and in July, the injury to a child case was dropped, also a misdemeanor.As part of a plea deal, Deane was going to face up to seven years in prison and a $15,000 fine on the felony drug charge. Prosecutors planned to recommend t迷你倉o years of supervised probation, a drug evaluation and 100 hours of community service. If she successfully completed probation, prosecutors would recommend that a judge set aside her guilty plea and dismiss the drug charge.Deane signed the deal on June 20. Branstad rejects bids to buy Iowa Communications Network

Terry Branstad said Wednesday he is rejecting bids to purchase Iowa's statewide fiber-optics network.Branstad followed a recommendation made in June by the Iowa Telecommunications and Technology Commission to turn down two bids made by Iowa Network Services, a West Des Moines telecommunications company that submitted the only two bids to buy the 25-year-old Iowa Communications Network (ICN)."Though I appreciate the time and effort it took for Iowa Network Services to develop their bids, I believe the ICN is worth more to the state of Iowa than what the bidder was willing to pay," Branstad said in a statement. "Not only were the bids significantly less than the amount the state has invested in the network over the years, the bids were less than the recent $25 million upgrade of the network."The company made one bid it valued at $57.4 million and another it valued at $44.5 million based on its evaluation of the network.But state commissioners valued INS' bids much lower, at $12.7 million and $1, respectively. The differences were based primarily on how accounts determined annual losses and cash-flow for the network. Iowa Network Services estimated that the network loses $36.1 million a year, but state officials say the operation has no loses."It would be a disservice to the taxpayers of Iowa to sell this important asset for pennies on the dollar," Branstad said."The ICN has been an important resource for Iowans over the past two decades, and we believe it can continue to provide an important service to those who depend on it," the governor added.Under Iowa law, the ICN cannot be sold without the prior authorization of the governor and a constitutional majority of both houses of the Legislature.According to commission documents, INS' base offer was a total estimated bid value of $57.4 million that included $12.7 million cash paid and $3.4 million additional cash for waivers of right of way fees for five years.The alternatmini storage INS offer laid out an estimated bid value of $44.5 million that included $1 cash paid and $3.4 million additional cash for waivers of right of way fees for five years. In addition, the alternate offer included a commitment for using $15.9 million for video network upgrades and Part III end-point fiber connections.Both the base and alternative offers incorporated a value of $5.2 million and $5 million, respectively, for future five-year incremental payments made by INS to the state from property taxes and sales taxes, and both offers assumed the elimination of ICN losses -- identified by INS at $36.1 million for the previous five-year period -- as part of the value of the offer.Branstad has indicated in the past that he believes the network -- which was built in the 1990s with federal money using public transportation right of way and is based in the Iowa National Guard's command center -- can be transferred into private hands under the right circumstances.However, many communication vendors in Iowa have viewed the ICN as unfair government competition and intrusion into the private sector, and both industry and state officials acknowledge that any ICN sale or lease arrangement would be closely scrutinized to make certain it did not negatively impact existing businesses.Lt. Gov. Kim Reynolds said many viewpoints and concerns were taken into account as administration officials weighed the ICN's future."Our office heard from a variety of stakeholders, including legislators, public safety leaders, health care providers, and members of the telecommunications industry," Reynolds said. "As a result, Iraq has suffered heavy direct losses, which we have determined conservatively at more than [4.6] billion US dollars," the letter said.TOTAL AGREES TO BUY CHEVRON'S RETAIL NETWORK IN EGYPT: French oil major Total has agreed to buy the Egyptian retail network of US energy company Chevron, in a move it said would create its biggest marketing and services subsidiary outside Europe, Reuters has reported. The network has annual sales of more than 1.4 million tonnes and includes 66 service stations, two oil depots and the aviation fuel operations at Cairo and Marsa Alam airports, said Total. The purchase is subject to approval by the relevant authorities, the firm said, without giving a value for the deal.IRAQ IMPROVES TERMS FOR NASIRIYA FIELD: Iraq has offered investors more lucrative terms to tap the Nasiriya oilfield and build a refinery, Reuters has reported, citing an Iraqi oil industry source. The project involves developing the southern field and building a 300,000 barrel-per-day refinery. A slowdown in Iraq's output has made companies complain about their slim margins on existing service contracts. "The oil ministry was keen to draft a contract which includes more lucrative and sweetened terms compared to the previous service contracts," the source said. "In this contract, operators will have no state partner and no signature bonus should be paid. That definitely will bring more profit for the project's operator."OMAN TO IMPORT IRANIAN GAS: Oman has signed a memorandum of understanding with Iran to import gas from 2015, in a 25-year deal valued at around $60bn, Reuters has reported. The MoU also includes an agreement to start laying a gas pipeline to Oman as soon as possible, according to the Iranian oil ministry. Analysts said Oman's enthusiasm for building the pipeline with Iran may depend on whether it can agree terms for BP to develop the Kazzan tight gas project, which could supply around one billion cubic feet per day by 2018.KUWAIT TO SPEND $5.28BN ON WATER PROJECTS UNTIL 2014: Kuwait Financial Centre (Markaz) has said the total investment in Kuwait's water sector between 2005 and 2014 stands at $5.28bn, Arab News has reported. Baghdad has signed a series of contracts with international oil majors to boost Iraq's output to 12m bpd by 2017, enough to make it the largest-producing country in the world.KACST SAYS SOLAR-POWERED DESAL PLANT TO BE OPERATIONAL BY 2013-END: The Energy Research Institute at Saudi Arabia's King Abdulaziz City for Science and Technology (KACST) has announced the first phase of the King Abdullah Initiative for Solar Water Desalination will be operational by the end of this year, Saudi Gazette has reported. The first phase of the project was launched in 2010 and involved the production of 10 megawatts of solar energy and reverse-osmosis membranes over a period of three years. As part of the project, two solar energy plants were constructed in Al-Khafji and in the solar village at Al-Oyainah, located 35 km from Riyadh. The plant would have a capacity of 30,000 cubic metres of drinking water a day to meet the needs of 100,000 people living in the town of Al-Khafji, near the Kuwaiti border.TAQA POSTPONES CONSTRUCTION OF $12BN COAL POWER PLANT IN TURKEY: Abu Dhabi National Energy Co (Taqa) has said commencement of construction of coal-fired power plants in Turkey has been postponed until 2014, citing other spending priorities, Reuters has reported. The state-owned oil explorer and power supplier greed in January with Turkey's state-owned Electricity Generation Co on a project worth up to $12bn to build several power plants using the lignite coal reserves of Turkey's Afsin-Elbistan region. Last June, Doha agreed to supply Egypt with five shipments to cover some of its needs, which increase during the hot summer. The total amount agreed has not been revealed, but traders say the shipments will only cover some of the gap in supply to Egypt, which has borrowed billions of dollars from abroad and delayed payments to oil companies and other suppliers.OMAN TO RECOVER, USE GAS FROM OIL WELLS: Oman's oil ministry and Oman Trading International have announced the registration of the Clean Development Mechanism (CDM) project in 'Block 9' of the Safah oil field, under the United Nations' Kyoto Protocol, Times of Oman has reported. The project, which is the first of its kind in the country, will recover and utilise gas from oil wells that would otherwise be flared or vented. It has adopted the CDM methodology 'AM0009' of the UN Framework Convention on Climate Change (UNFCCC). 芭提雅快艇撞船 兩華客死
