●未來五至十年，self storage新舊經濟會發生更為激烈的碰撞，但碰撞的結果，並不是把傳統經濟消滅，而是吞併和同化，從而煥發新生。張曉崧中國經濟大變天的提法，可能很多人並不認同。有些人可能會認為，這些年中國經濟的發展很健康，不存在什麼大變天。也有些人會認為，中國經濟現在雖然面臨深度調整，或者說面臨危機，但也談不上有什麼大變天。但在從事新經濟活動的企業家中，會有相當一部分人認同這種提法。去年底，在我們泰山會年會上，馬雲提到，感覺現在不是一般的改變，而是天在變。當然他主要指的是電子商務領域和商品流通領域。但是如果我們仔細觀察，其實中國經濟的許多領域都在發生變天，都在出現各種意想不到的顛覆。傳統實體經濟的困境對於中國經濟的前景，我們圈內企業家有一個基本判斷，房地產的好日子可能也就是三到五年，有的人甚至更悲觀一點，認為可能就兩到三年。對於“鐵、公、基”以及相關產業，好日子可能也就是兩到三年。一些傳統制造業，好日子也就是三到五年。為什麼?比如房子再蓋三到五年，估計就飽和了，隨著出生人口的下降和獨生子女政策的延續，甚至會出現下一代房子過剩的局面。所以房地產將來很難再有更大的發展和增值空間。另外，高速公路、輕軌、高鐵建多少條，這一定是有限度的。美國是在上世紀30年代基本完成了高速公路的建設。中國未來5年之內，高速公路、高鐵、輕軌、地鐵的建設，基礎設施的建設，基本上都會完成。與之相關的產業，三五年後都會遇到發展瓶頸。中國經濟的現狀，表面看是房地產泡沫和銀行資金錯配造成中國實體經濟的衰退;龐大的銀行資產和政府投資、企業投資、個人投資都堆積在房地產及相關公共配套設施等一兩個籃子中，結構失衡;一旦熱錢流動趨勢發生逆轉，房地產保值增值預期落空，大規模的債務危機、金融危機將會隨時爆發。但實際上，中國經濟困局還有更深刻的內在原因。從2008年次貸危機開始到現在的五年中，發生了三件深刻影響中國經濟格局的大事:一是“四萬億”經濟刺激計劃的推出，導致流動性泛濫和房價暴漲;二是2008年新勞動法的出台，導致企業活力大幅下降，勞動力成本大幅上升;三是智能手機的問世，導致網絡人的出現和網絡人消費服務經濟的爆發性增長。在我看來，第二件事和第三件事對中國過去、現在和未來的影響，要遠遠超過第一件事。新勞動法出台于2008年，從事製造業的企業和勞動密集型企業也主要是從2008、2009年開始大規模轉向投資房地產，兩者同步絕非巧合。中國的大多數中小微企業能生存主要靠兩條:一是儘量避稅，二是用工自由，勞動力成本低。新勞動法出台後，企業用人自主權大幅度受限，勞動力成本大幅度上升，企業的用人合約成本係數至少增加十倍以上。據我所知，即便像聯想、海爾、海信這樣優秀的製造業企業，近五年也都在大量投資房地產，其主要的收益增長點不是來源於製造業，而是來源於房地產和其他投資收益。說得更直白一點，2008年實施的《勞動合同法》就像一道閘門，堵住了寬鬆的貨幣之水流向實體經濟，從而大大推動了房地產業的流動性泛濫和銀行資產配置的失衡。唯其如此，經濟學家張五常才把新勞動法痛斥為阻礙中國經濟發展導致實體經濟衰退的惡法。平心而論，勞動法的基本原則無疑是好的，也是必要的;但2008年勞動法修訂的有些條款確實脫離中國實際，缺乏可操作性。以我們企業為例，近五年，人均工資增加了三倍左右，房租也增加了三倍左右，但企業產品價格十年中僅增加了30%。綜上所述，新勞動法的束縛、新經濟的擠壓、土地財政的透支、傳統產業需求的瓶頸、人口紅利的消失、體制改革的滯後、國內外熱錢的撤離這幾大因素的交互作用，造成中國傳統實體經濟出現目前的困境，短期面臨結構性危機和調整是毋庸置疑的。網絡人的誕生與新經濟新經濟和網絡人息息相關。所以要弄清新經濟的主要特點，首先就要弄清網絡人的特點。什麼是網絡人?當你上網看手機、看平板、看電腦的時候，你就是網絡人。講一個真實的例子，就是我們泰山會內部有一個微信群，有一天，其中五個人，從早上九點半開始在手機上互發微信，一直發到下午兩點半，五個多小時發了近百條。這說明很多企業家都已經進入到網絡人的一種生活狀態。據統計，截至2012年12月底，中國網民規模達5.64億，網民中使用手機上網的用戶占比由2011年底的69.3%提升至74.5%。截至今年5月份，移動互聯網人數已經比PC互聯網高28.9%，這就意味著，當互聯網顛覆傳統行業的時候，互聯網本身正在被移動互聯網顛覆。新經濟就是為網絡人消費和服務的經濟。新經濟不是把傳統經濟簡單拋棄，而是在傳統經濟的基礎上生長起來並讓傳統經濟獲得新生。我認為，新經濟的最大特點是跨界。新經濟對政府和各種體制障礙的最大要求就是鬆綁。新經濟將打破許多過去傳統經濟的界限，出現許多越界跨界問題。例如樂視網推出超級電視，例如健康物聯(業務範圍橫跨工業信息化部、衛生計生委、食藥局多個部門)，例如遠程會診、淘寶掛號等等。新經濟的第二個特點是時尚化、遊戲化。新經濟第三個特點是消費者成為真正的主人、主體、中心，消費者有充分的自主權和自由度，消費者具有越來越多的選擇權。新經濟的第四個特點是開放性基礎上的全球化。新經濟發展的體制障礙一是2008年新勞動法中一些條款的脫離實際和缺乏可操作性。二是工商管理部門是當前改革的重中之重。比如工商登記年檢繁瑣，比如營業範圍劃分過細，限制過多。再比如關於異地辦公，小米手機在北京市海澱區註冊，但是搬到朝陽區望京辦公，因為那裡的寫字樓更便宜，這在網絡時代是很正常的事。但是工商部門認為這是異地辦公，不允許，要罰款。三是在新經濟的科技創新活動中，民企和小微企業將成為創新的主體，但企業人才在職稱、獲獎、資助方面，基本被邊緣化。四是醫療服務、金融保險等許多壟斷性領域，對民營企業的各種禁入。五是公務員隊伍的龐大和部門的繁多，造成管事太多太細，加大了小微企業的經營成本與交際成本。六是新經濟將成就更多的小微企業和自由職業者，需要大規模減稅;但現在稅賦太重，即便最好的民企500強近五年也首次出現了稅後淨利潤低於總稅賦的情況。數據顯示，2012年民企500強實現稅後淨利潤4238.44億元，納稅總額竟達到4334.78億元。華為以253億元的納稅額居500強之首，同期淨利潤為153.8億元。民企500強稅後淨利潤比2011年下降3.39%。七是政府權力過大和濫用，缺乏法律約束，加上立法缺陷和選擇性執法，造成民營企業的許多權益得不到體制的真正保護，企業主缺乏安全感。八是國有企業和民營企業競爭條件不平等。例如貸款，央企可以授信且不需要擔保抵押，利息還低———是民企的一半或三分之一。中國新經濟中的“小崗村”在我看來，小崗村的意義就是越界和鬆綁。過去三十多年，中國改革開放過程，就是迷你倉個不斷越界和鬆綁的過程。許多不許幹的事都允許幹了，所以才出現中國經濟三十多年的巨變，成為世界第二大經濟體。新經濟需要一次更廣泛、更深刻的跨界與鬆綁。我們不要認為，網絡化時代只會存在像阿里巴巴、騰訊這樣的企業，其實還會成就一大批新興的中小微企業。前段時間我參加了淘寶十周年慶典，可容納四萬人的體育場，有兩萬多人是淘寶員工，還有一萬多人是淘寶客戶，全是中小微企業的代表或叫網店店主。在這個會場上，你絕對不會感到中國未來五年、十年的經濟會衰退，你會感覺到有一股不可遏制的力量在蓬勃生長。不過需要說明的是，淘寶上的中小微企業之所以能展現出蓬勃活力，一個重要因素在於對稅法和勞動法等的規避;在於這一領域的政府干預最少，市場化程度最高。淘寶網店店主的越界和優勢主要表現在五個方面:一是審批最少，基本沒有政府審批;二是監管最弱，基本沒有政府各部門的檢查管制;三是稅賦最輕，基本不用交稅;四是用工最自由，基本不受勞動法的約束;五是市場自律性最強，對用戶評級信譽最重視。在同樣的法律法規約束下，傳統實體經濟和新經濟為何冰火兩重天?原因在於政府對舊經濟和新經濟採取了完全不同的態度和做法。看傳統經濟那只眼睛睜得大大的，絕不容許越雷池半步;但看新經濟那只眼眯得小小的，只要不惹出大事兒就裝看不見，先放手發展。所以，盡管新經濟發展的體制障礙很多，但在實際操作中仍然具有較大的發展空間。這是中國經濟的一大特色，也是中國經濟的活力和希望所在。中國改革開放以來的兩次大規模跨界，第一次是從小崗村開始的30年，從計劃經濟走向市場經濟，不斷跨界，改革重點就是圍繞著對這種跨界行為的全面鬆綁;第二次是2008年網絡人出現到未來的30年，從傳統實體經濟走向網絡化虛擬化新經濟，改革的重點仍然是對這種大規模跨界行為的全面鬆綁。所以現在特別需要提倡新時代的“小崗村”。新經濟的前景未來五至十年，新舊經濟會發生更為激烈的碰撞，但碰撞的結果，並不是把傳統經濟消滅，而是吞併和同化，從而煥發新生。我認為，新經濟的發展，特別是基於互聯網、移動網、物聯網、雲計算技術的發展很可能會使中國經濟轉向一個新的持續增長的階段。也就是說，未來五到十年中國經濟增長的主要動力就是新經濟。過去的許多政策法規，在新經濟面前都會變得非常可笑，會阻礙新經濟的發展。以三網合一為特徵的新經濟需要不斷創新，需要不斷跨界，所以很多過去基於傳統實體經濟的審批限制要取消;網絡的公開透明使信息不對稱越來越少，使信用變得越來越重要，市場自身的監管要遠勝于政府部門的人為監管。對社會生活的影響:不僅電子商務會成為商品交易流通的主流，而且網絡醫院、網絡養老院、網絡家庭、網絡美容養生會所、網絡家政、智能家居都將成為現實並普及。對金融的影響:貨幣形態對貨幣發行量有決定性影響，而貨幣發行量又會直接影響經濟社會發展速度。貨幣形態從金銀珠寶等實物貨幣走向紙幣，再走向電子貨幣，現在又出現虛擬貨幣例如Q幣或遊戲幣，每一次貨幣形態的變化都給人類經濟活動和社會生活帶來深刻影響和巨大變化。生產力決定生產關係，經濟基礎決定上層建築。新經濟的生產力和生產關係決定了小政府、服務型政府和自律型社會、自組織社會才能與之相適應。新經濟發展之道走出目前中國經濟困局發展新經濟的應對之道，概括起來有十二個字:緊挖渠，寬貨幣，減支出，降稅收。緊挖渠就是要讓寬鬆的貨幣之水，流向實體經濟、農村經濟和網絡人經濟，儘快破除通向這些領域的限制和梗阻。在城市經濟中，調整2008年新勞動法，調動廣大中小微企業吸納農村外出勞動力的積極性;在農村經濟中，實現農民土地確權和流轉，推動農業的產業化、現代化和農村人口的城鎮化;在網絡人經濟中，掃清各種束縛新經濟發展的體制性障礙，取消跨界限制和不必要的審批，實現企業經營範圍和經營方式的備案制。例如可考慮對從事實體經濟和新經濟用工十人以下或人均年收入三萬元以下的小微企業一律免稅並由國家負擔保險。寬貨幣就是要充分保證市場流動性，適時降息降准，推進利率匯率市場化，扶持民間金融業，放開直接融資市場，大力支持實體經濟、農村經濟和網絡人經濟的發展。最近五年，世界各國都在超發貨幣，但並未出現過去必然相伴的嚴重通脹危機。美國、歐洲、日本的通脹都不明顯。超發的貨幣都跑哪去了?在中國，可能大部分是被房地產市場吸納了;但就世界經濟而言，除了一部分流向新興國家外，還有相當一部分應該是被最近十年開始興起特別是最近五年加速發展的新經濟即虛擬經濟吸納了。兩者時間上的同步，有著深刻的必然聯繫。需要強調的是，現在貨幣政策不能猛然緊縮的另一個原因在於，中國經濟就像一個危重病人，過去看上去很健康，是因為一直在輸氧輸血輸液;現在發現有大病了，第一要務是對症下藥，積極治病，而不是停止輸氧、輸液、輸血。貨幣錯配盤活等問題，只能在治病康複的過程中逐步解決。更何況，新經濟的繁榮發展是需要貨幣政策適當寬鬆做支撐的。減支出就是要壓縮財政支出和投資，實現小政府和服務型政府。最近幾個月，“習李新政”的改革取向和措施，總體上還是值得稱道的。尤其是讓政府先過緊日子，以身作則糾風反腐，更是深得民心。下一步還應轉變政府觀念，破除官本位痼疾，壓縮龐大的政府機構，分流政府人員，由公務員熱變成下海熱、創業熱。尤其值得注意的是，地方政府在擴大政府投資、增加財稅收入方面的衝動，依然十分強烈。如不注意克制，必將進一步加重實體經濟、新興經濟和中小微企業的負擔，使中國經濟雪上加霜。以上十二字都離不開改革開放四個字，離不開小崗村的跨界鬆綁精神。我認為，只要改革開放到位，堅決掃清束縛新經濟發展的各種體制性障礙，未來五到十年，新經濟特別是網絡人經濟的興起，會彌補傳統產業和實體經濟衰退對中國經濟的影響。從這一點來說，我還是看好未來中國經濟的五到十年甚或二十年。最後想說一點，解決新經濟發展中的體制性障礙，首先還是要開放和活躍思想市場。正像科斯在其著作《變革中國》中認為的那樣，中國經濟的進一步發展和市場制度的完善，最大的阻力和障礙在於“從經濟到教育，從法律到政治，中國社會的每個角落都缺乏充滿活力的思想市場”。中國的實際生活中，特別是新經濟的發展中，已經存在大量的創新，但是我們的思想市場，卻仍然被各種各樣過時陳舊的思想和觀念所籠罩。生命之樹常青，理論總是灰色的。思想理論滯後于實際生活，體制規章又滯後于思想理論。所以要打破體制障礙，破除各種對新經濟發展的束縛，首先要做的，還是解放思想，開放和活躍思想市場。(作者系萬源企業董事長兼萬度網絡技術有限公司董事長、中國經濟體制改革研究會理事。本文根據作者9月7日在洪範法律與經濟研究所學術研討會上的發言整理而成。李雅琦、田春玲編輯，工作郵箱:tianchun|ing@wxjt.com.cn)文件倉

Source: Tulsa World, Okla.文件倉Sept. 23--With negotiations ending between two sets of parents Monday morning, the Oklahoma Supreme Court lifted a ruling this afternoon that was keeping Baby Veronica with her biological father, according to online court records.With 4-year-old Veronica staying on tribal land near Tahlequah, it would apparently take a tribal court order or a federal court order to remove the girl from her biological father, Dusten Brown."This order, just like any other order from a foreign jurisdiction needs to be filed for domestication with the Cherokee Nation District Court," said Cherokee Nation Attorney General Todd Hembree. "There is a conflicting Cherokee Nation order concerning a Cherokee Nation citizen on Cherokee Nation land. We are a sovereign nation with a valid and historic court system."As Attorney General, I will require that our court system be honored and respected. I took an oath when assuming this office to uphold the laws and constitution of the Cherokee Nation and the United States. Nowhere in that oath is it required that I defend the laws of South Carolina."Matt and Melanie Capobianco came to Oklahoma more than a month ago to bring their daughter back to South Carolina, where they raised Veronica, a Cherokee citizen, for the first 27 months of her life. A spokesperson for the family said the supreme court's decision today means "a long legal nightmare finally has come to an end."Matt and Melanie cannot wait to bring Veronica home and begin the healing process as a reunited family. Their hope now is that the Brown family and Cherokee Nation will return Veronica peacefully and voluntarily, rather than following through with their previous threats to continue to ignore court orders and place Veronica in a dangerous and traumatic situation."But Clark Brewster, an attorney representing Brown, said, "This situation is far from resolved. Dusten Brown will do everything he can within the law to challenge this decision."The Oklahoma Supreme Court ruled that it would no longer block a Nowata County court's order that confirmed Veronica's South Carolina adoption. The Nowata County order demanded that Brown turn the girl over to the Capobaincos immediately.Brown and the Cherokee Nation appealed the order to the Oklahoma Supreme Court, which instructed the Civil Court of Appeals in Tulsa to have mediation with the girl's parents. Last week, the two sides met for five days -- about 30 hours -- and didn't reach an agreement."All the parties negotiated in good faith in my opinion and have been represented by lawyers of competence, skill and diligence," a settlement judge told the Tulsa World this morning."It is a procedurally and substantively complex case, which we simply were unable to resolve by a settlement agreement. As a consequence, the settlement conference was adjourned this morning, and the parties and their attorneys instructed that all gag orders remain operative and in effect."Brewster did not reveal details of the negotia存倉ions. In a text message to the Tulsa World, Brewster said:"Dusten tried in every way to reason with the Capobiancos and their legal team of Washington, D.C., and local lawyers. We have spent the past five days trying to forge an agreement to no avail."Although the Oklahoma Supreme Court today dissolved its order ... we will confer with Dusten about his remaining legal options and vigorously pursue Veronica's right to have her best interests be the paramount consideration."Brewster said Brown could continue his appeals to the Oklahoma Supreme Court.After spending the first two years of her life in South Carolina with the Capobiancos, Veronica has lived the last two years with Brown and his family in Nowata, about an hour north of Tulsa.After a week-long mediation conference in downtown Tulsa, negotiations ended Monday morning without an agreement between Veronica's parents. Walking in without attorneys, the Capobiancos arrived at the courthouse just before 9 a.m. Brown and his attorney, Rob Nigh, walked in shortly afterward, with a supporter briefly stopping the biological father to shake his hand. They left less than an hour later.The custody battle has snaked through a legal maze in Oklahoma, where the parents have visited seven different courthouses in six different counties.The legal battles include a felony warrant for Brown in South Carolina, where he's facing a complaint of custodial interference for not giving the girl back to the Capobiancos.His attorneys have argued that he's under no legal obligation to obey the South Carolina court order while the case remains under appeal in Oklahoma.He'll face an extradition hearing Oct. 3 in Sequoyah County, where a judge could send him to South Carolina.The settlement negotiations would have ended the criminal case against Brown, too, if an agreement had been reached.In the past, the Capobiancos have said that they wanted Brown and his Cherokee family to be "a part of Veronica's life," but they have not publicly offered a specific compromise.Earlier this year, members of the Brown family revealed a proposal to send Veronica to South Carolina every summer, but keep her in Oklahoma for the school year.Any compromise presumably would have included at least visitation rights for Brown, who has had custody of Veronica since December 2011.After arranging a private adoption with Brown's ex-fiancee, the Capobiancos lost custody of Veronica after courts in South Carolina ruled that Brown had not given "voluntary consent" to the adoption.But the couple appealed the decision all the way to the U.S. Supreme Court, which decided 5-4 that the lower courts had misinterpreted a federal law when they gave custody to Brown.While the Supreme Court's decision struck down part of his case, Brown's attorneys have argued that he can still challenge the adoption on other grounds.Copyright: ___ (c)2013 Tulsa World (Tulsa, Okla.) Source: The Montana Standard, ButteSept.迷你倉 22--Company disputes quadrupled rate in Mont.HELENA -- The Montana Supreme Court will hear oral arguments Wednesday in a multimillion-dollar dispute over the state Revenue Department's changing how Bresnan Communications' properties were assessed for taxes.The Revenue Department is appealing a 2012 decision by state District Judge Susan Watters of Billings, in favor of Bresnan, now owned by Charter Communications.Watters ruled that the Revenue Department illegally lumped all Bresnan's properties -- such as those needed to provide cable television, Internet and telephone services -- into one classification for tax purposes. The agency, she said, also wrongly ordered all of the properties to be centrally assessed by the state as a telecommunications service company.The department's decision effectively doubled the tax rate on some of Bresnan's property, from3 percent to 6 percent, and raised its total property taxes.Bresnan said the department's changes more than quadrupled its Montana property taxes, from $1.7 million in 2009 to $7.3 million in 2010.Watters' decision lowered Bresnan's property tax bill by $5.6 million in 2010 alone.The Revenue Department defended its assessment changes."The Legislature has directed the department to assess telecommunications companies as a unit when they are used as a unit," C A Daw, the department's chief legal counsel, told Lee Newspapers State Bureau last week. "Trying to break a modern integrated telecommunications company like Bresnan up into component pieces is a shell game that shifts the tax burden to other taxpayers, including homeowners and small businesses."Charter released this statement to the State Bureau prior to the hearing: "Bresnan has always fully and properly paid its state and local taxes, and the District Court that heard all the evidence related to this dispute agreed. The department's efforts to retroactively change what Bresnan pays is not supported by the laws of this state or by the facts of this case."The dispute arose after the Revenue Department, following an audit, reclassified Bresnan's property as a "centrally assessed telecommunicationsservices company" fortax year 2010.When Bresnan bought the company in 2003, it provided customers with only one-way cabletelevision, and in limited markets, two-way data or Internet service, Revenue Department lawyers said in a brief.But by tax years 2007 to 2010, Bresnan offered cable television (video), telephone (voice) and Internet services over a single network, promoting it as the company's "Triple Play" to customers in 20 Montana counties and in Wyoming, Colorado and Utah, the state's brief said. Bresnan upgraded its property to allow for enhanced video services such as video on demand, and added Internet and residential and commercial voice service.The department said Bresnan boasted in advertising that it had "invested hund迷你倉最平eds of millions of dollars to bring state of the art telecommunications infrastructure to Montana."The Revenue Department previously had classified Bresnan's locally reported properties under Class 8, which covers cable television systems, with a tax rate of 3 percent.Bresnan centrally reported its voice operations under Bresnan Digital Services, and its microwave operation in tax years 2007-2009, under Class 13, with a 6 percent tax rate."Filing as three separate entities meant Bresnan had to divvy its assets among its reporting forms," the Revenue Department brief said. "Bresnan apportioned over 90 percent of its property to its locally reported filings with the attendant3 percent tax rate."After the audit, the department concluded that Bresnan operated as "a single and continuous interstate and inter-county telecommunications services company" and by law As needed to centrally assess and classify all Bresnan's property under Class 13.The Revenue Department also revised the company's assessments for 2007-2009.Bresnan sued, saying the department decision to assign all of its properties to Class 13 was "illegal, improper and a violation of law."From the outset, Bresnan it was obliged to segregate its video, voice and data services forvarious reasons.State law imposes excise taxes on voice services but not on video or data. Cable franchise agreements, through which Bresnan obtained the right to install cable TV systems in public rights-of-way, impose franchise fees on video revenues, but not on voice or data. Bresnan also offered residential voice through a third-party vendor, which had a revenue-sharing arrangement through from voice but not from video or data.The company said it also segregated equipment and revenues for property tax purposes."Many Montana taxpayers own property, and are assessed by the department, in more than one property tax class," Bresnan attorneys said. "All Montana cable television systems are locally assessed under Class 8. As instructed, Bresnan reported, was assessed and paid property taxes under both Class 8 and Class 13."But in 2010, Bresnan said, the Revenue Department unilaterally changed its method of assessment, putting all its company's Montana properties into Class 13 central assessment, and do so retroactively.The department said it has the legal authority to revise assessments for past years."It is illogical that the Legislature would grant (the department) the authority to investigate a taxpayer to ensure its property value was assessed at 100 percent of its market value, but prevent the agency from taking the steps necessary to resolving inconsistencies or errors discovered by the investigation," the Revenue Department said.Wednesday's arguments begin at 9:30 a.m.Copyright: ___ (c)2013 The Montana Standard (Butte, Mont.) Source: Pittsburgh Post-GazetteSept.儲存 22--Americans who believe their charitable contributions, political affiliation or the number of credit card transactions they made in the past 13 months are private matters were delivered a cold dose of reality this month.About two weeks ago, a Little Rock, Ark.-based data analytics and software company unveiled a website that allows consumers to take a firsthand look at the types and scope of online personal data that have been collected about them.And there's a lot.Acxiom, which performs services ranging from online and offline marketing to scanning electronic data to help authorities find criminals, manages more than 32 billion consumer and business data records updated monthly.Through its AboutTheData.com project, Acxiom is lifting the curtain between online consumers and the third party vendors who compile digital portraits of each and every one of them -- one megabyte at a time.Consumers who want to check it out have to enter some personal information -- name, address, birth date, email address and the last four digits of a Social Security number -- and then they are directed to a portal that allows them to access educational, financial and personal information that has been attached to the account.They'll see what the data manager believes is their education level; their political affiliation; whether they own a home; what kind of car they drive -- whether it's a 2010 Mercedes sedan or a 2000 Ford pickup truck; how much money is coming into their household; how often they use credit cards to buy stuff; and even whether they lean to the left or right of the political spectrum.Made a donation to the Tea Party? The Coffee Party? The Green Party? It's in there.To get its picture of individual Americans, the company site says it draws from all sorts of places where people have either done something that goes in the public record or have agreed to share a little information.That includes collecting public records, surveys and questionnaires, website directories and postings, property records and data from online companies that have alerted consumers that their information will be used for marketing purposes.Consumers who pull up their own profile on AboutTheData.com have the option to correct any mistakes found in their personal profiles, or to opt out of the company's online advertising products and its marketing and directory list.Acxiom CEO Scott Howe said the portal has been in the works for several years and the current beta version will be updated depending on user feedback."After 40-plus years of advocating for the responsible use of consumer data, we're now taking our first step in establishing a direct relationship with consumers and plan to grow the site and its capabilities over time," Mr. Howe said in a press release.The increased transparency comes at a time when Americans are increasingly pushing back against digital tracking, which has become a much bigger issue in 迷你倉ecent years as more things go online.The Pew Research Center survey "Anonymity, Privacy and Security Online," released Sept. 5, shows that 86 percent of adult Internet users have taken steps to avoid surveillance; 55 percent have sought to avoid surveillance by specific people, organizations or government entities; and 50 percent are worried about the amount of personal information that's available online.Sixty-four percent of respondents said they clear cookies and browser histories to avoid detection, and a surprising 14 percent said they go as far as encrypting email and using virtual networks that disguise IP addresses to duck surveillance.The Acxiom project hasn't won over those concerned about the issue of privacy.John Simpson, privacy project director of Washington D.C.-based Consumer Watchdog, said AboutTheData.com provides some transparency but is ultimately an attempt to avoid government regulation."What's really crystal clear to me is that their motivations in doing this is not anything particularly beneficial to the consumer. They did it because the whole data [collection] industry is finally being scrutinized by consumers and it's a bid to avoid regulators."He believes a comprehensive do-not-track law, which would provide government enforcement for consumer's requests not to be tracked online, is the best way to approach the issue of privacy. Currently, several Web browsers are equipped to tell sites when a user does not wish to be tracked but there is no law requiring websites to obey those instructions.Michelle De Mooy, a senior associate for national priorities with Washington, D.C.-based Consumer Action, said the new website creates a Catch-22 in the sense that, in order for customers to correct or delete their personal data, they must first provide even more detailed personal data.She said several initiatives geared toward government-enforced do-not-track regulations have stalled in the legislature and an attempt by the World Wide Web Consortium to create a standard do-not-track mechanism suffered a similar fate.With government-enforced privacy standards still a pipe dream, Ms. De Mooy said education is the best bet for privacy protection. Consumer Action's new website, RespectMyDNT.org, is an attempt to give consumers a general idea of how prevalent tracking has become, as well as offering options to avoid tracking and means of contacting legislators to promote do-not-track laws."We felt it was the right time to launch a project taps into this public awareness and encourages consumers to learn about and get involved in the issues around DNT," Ms. De Mooy said in a press release."After all, they've told us repeatedly that they want the ability to control tracking and this is one way to do it."Deborah M. Source: American News, Aberdeen, S.self storageD.Sept. 22--Out of more than 10,000 volunteers who send weather data to the National Weather Service, two of the most dependable volunteers in the nation live about 15 minutes apart from each other.Marvin Seyer of Ipswich and Leland Treichel of Roscoe were each presented with an award from the weather service for their consistency and commitment to providing the weather service with accurate data."They are responsible for giving us the high and low temperature and the precipitation reports 365 days a year," said Tim Kearns, data acquisition program manager for the weather service in Aberdeen. Leland hasn't missed an observation in 24 years, Marvin hasn't missed one in 38 years."On Sept. 3, Treichel, a real estate broker, insurance agent and the Edmunds County emergency manager, was one of 17 people to earn the John Campanius Holm Award, which is granted each year to a maximum of 25 observers for outstanding accomplishments in the field of cooperative observing. A person must spend at least 20 years running a cooperative weather station to be eligible to win the award.One week later, on Sept. 10, Seyer, a retired school teacher from Ipswich High School, was one of five people nationwide who received the Thomas Jefferson Award, the highest honor the weather service can bestow. To win the Jefferson award, a person must have already won the Holm award then spend a minimum of five years running a cooperative weather station. Seyer won the Holm award in 2006.Treichel and Holm were honored with a ceremony by the weather service, a plaque and had the day named in their honor by Gov. Dennis Daugaard."It's a routine, like having a daily cup of coffee," Seyer said.Each of their routines is slightly different. Treichel takes his measurements at 7 a.m. each morning, while Seyer takes his at 10 p.m. just before his bedtime. But they have always collected the data. Day after day, year after year."You don't have too many people stay with it," Seyer said.They use similar equipment, each of them has a solar-protected so they can record the air temperature without being affected by direct sunlight and a collection tube to check how much precipitation fell during the previous 24 hours. The only difference is Treichel bought an anemometer to track wind, which Seyer does not have.Each of them have made arrangements in case they have to go out of town or are unable to collect the data for some reason. Treichel said he has several neighbors he can depend on and Seyer said he can rely on his son-in-law or daughter-in-law if necessary.Year after yearTheir levels of dedication, consistency and organization are not traits limited to their weather data collection. It's embedded in their personalities.When Treichel, now 62, was growing up, his best friend's father had houses for purple martins. He used to watch them fly in his friend's backyard and decided he wanted to have purple martins, so 24 years ago he bought purple martin housing.Because purple martins are notoriously picky when it comes to choosing a nesting site, it was 12 years before the first birds established a nest, but for 11 consecutive years he maintained the housing and researched ways to attract them.This year, Treichel said he had 136 adult birds that hatched 278 babies. Watching them fly around with his wife, Tracy, gives the couple a great deal of joy."We spend hours sitting on the deck and watching them," he said.Inside the Ipswich High School's gym lobby is an example of Seyer's dedication. In 1975, Seyer, who 迷你倉tarted teaching social studies in 1964, established what he calls the athletics "hall of fame" and has kept up with it since.He helped established the criteria to make the hall of fame. An athlete must earn 10 athletic letters, make All-State or complete sport-specific achievements."We have a lot of recognition for our athletes. We display everything," Seyer said. "Too many schools keep their trophies in the coaches' office or a trophy room."The criteria is displayed in the lobby to give athletes a goal to aspire to, Seyer said. He is particularly proud of his idea to make sure three of an athlete's academic letters must be earned in their senior year, to keep them motivated in their final year of high school.Need more evidence? Go to Ipswich's Homecoming Day parade, which Seyer has organized every year since it was re-established in 1992. Or look at the walls inside Treichel's office, which are adorned with all sorts of plaques acknowledging decades of service as an insurance agent, emergency manager, notary public and a home inspector.Observer storiesWith more than 60 years of weather observations combined, Seyer and Treichel can remember some crazy weather, the type that makes South Dakotans snicker at people new to the state who claim they're used to cold weather.One of the most memorable experiences Seyer had was on Dec. 23, 1983. That night was one of the coldest he can remember."It was so cold, the bottom fell out of the thermometer," he said. "usually when you have a real cold night, you don't have any wind, but that night we had something like a 40 mph wind."After midnight, the air temperature dropped to 40 degrees below zero, but felt like 80 degrees below zero because of the wind chill factor, he said.He said he can remember the night so vividly because he and his wife, Judy, hosted a Christmas party that night and his guests had to walk outside routinely."The guests had to go out and start their car about every half-hour just to make sure their car would start when it was time to leave," Seyer said.That was one of the scariest nights he can remember, but there were two blessings that night, Seyer said. The first was that there wasn't much snow on the ground, so cars weren't stuck. The second was that the electricity stayed on."It was a miracle with that kind of wind, we wouldn't have a power outage," he said.Since Treichel is a trained weather spotter and the Edmunds County Emergency Manager, his most memorable experience with weather wasn't extreme cold or heat. It was chasing a tornado.In 2010, Treichel and his wife hopped in their pickup truck to track a tornado that had torn up several farms near Bowdle.He had a dash camera in his pickup and took a video of the tornado. which he said was almost a mile wide.Although he'd seen the video before, he was still awed by the tornados' size and how close he and his wife were to it before they turned back.He said the video was shown at an emergency managers conference, which was a proud moment for him.Treichel said his goal is to eventually win the Thomas Jefferson award, as Seyer had, but that there was still a long way to go.Seyer wasn't able to explain why he kept sending weather observations records for so long. It just never crossed his mind to stop."I don't think about why I should do something," he said.
