Source: Pittsburgh Post-GazetteSept.self storage 25--The daughter of former Pennsylvania Supreme Court Justice Joan Orie Melvin was scheduled for a preliminary arraignment this morning after having been arrested last week and charged with insurance fraud.Casey Melvin, 25, was scheduled for the hearing this morning with Magisterial District Judge James J. Hanley Jr.The charges stem from a one-vehicle car crash on March 29, 2012, in Shaler.According to a police report, Ms. Melvin reported a crash at 12:54 p.m. that day in the 800 block of Butler Street.Ms. Melvin told the responding officer that she was distracted when leaving Shaler Plaza and drove into a utility pole. Both air bags from her 2011 Jeep Laredo deployed and the vehicle was towed.Last year, a representative with Progressive insurance told the Pittsburgh Post-Gazette that Ms. Melvin attempted to submit a claim for the crash but it was denied because her policy had been canceled.Although there is generally a grace period of 15 to 20 days, Ms. Melvin's crash happened after that.According to the affidavit, Progressive sent Ms. Melvin a notice of cancellation or refusal to renew on March 12, noting that her payment had not been received and that coverage would lapse on March 28 at 12:01 a.m.Following the accident, at 12:57 p.m. on March 29, "Casey Melvin called and renewed the insurance coverage."During the call, she acknowledged there would be a gap in coverage from March 10 through March 30, and that "she would have no insurance coverage for either herself or her vehicle" during that time."The Progressive representative also advised that the particular state where she resides may assess fines ... for the insurance lapse."Ms. Melvin,迷你倉according to the affidavit, asked if she could renew the policy without the gap but was told she could not.Then, on April 4, at 12:44 p.m., Ms. Melvin filed an accident claim by telephone for her vehicle.When asked when the accident occurred, the affidavit said, Ms. Melvin said, "this past Friday," which was March 30.According to the affidavit a charge of insurance fraud is warranted because Ms. Melvin "presented the insurer Progressive Insurance a statement forming a part of, or in support of a claim that contained false, incomplete or misleading information concerning any fact or thing material to an accident claim that occurred on March 29, 2012, at 12:57 p.m. and policy status.In May, the Allegheny County District Attorney's office attempted to refer the case to the Pennsylvania Attorney General's office "to avoid any appearance of conflict" because of the DA's prosecution of Orie Melvin, according to a letter obtained today.The AG's office said there was an even greater conflict there because Ms. Melvin's uncle, Jerry Orie, is a prosecutor in the office who handles insurance fraud."We were not aware that Mr. Orie was responsible for prosecuting such cases and therefore withdrew the request," District Attorney Stephen A. Zappala Jr. wrote in a letter to Attorney General Kathleen Kane.The third-degree felony charge was filed by the DA's office.Ms. Melvin was released on her own recognizance.
